The Chemical, Biological, Radiological and Nuclear (CBRN) team, part of the Defence Equipment and Support (DE&S) organisation within the UK Ministry of Defence (MOD), intends to place a new 5-year contract (with 5x Option Years) with Spectral Laboratories Incorporated as the Original Equipment Manufacturer (OEM). This will maintain the operational capability over the period with additional Options Years if required.
The new contract will ensure the provision of In-Service Support including technical upgrades, spares provision and obsolescence mitigation, to maintain the Naval Fleet Radiation Monitoring Capability. This comprises of Ship Installed Air Particle Detection systems. The value of the requirement is approx. £3m.

Voluntary Transparency Notice APD In Service Support Contract
Short Description of the procurement:

Negotiated procedure without prior publication of a contract notice, pursuant to Regulation 16(1)(a)(ii) of the UK Defence and Security Public Contract Regulations 2011(as amended) for Technical Reasons.
Explanation
In accordance with Regulation 4 of the Defence and Security Contracts (Amendment) (EU Exit) 2019 Regulations (SI 2019/697) this procurement falls to be regulated under the provisions of the Defence and Security Public Contracts Regulations 2011 as amended (by SI 2019/697 and SI 2020/1450). Prior publication of a contract notice in the official Journal of the European Union is no longer appropriate. It is considered that the award of this contract without prior publication of a contract notice in the UK e-notification service (as required by the relevant legislation) is lawful in accordance with Regulation 16(1)(a)(ii) of the Defence and Security Public Contract Regulations 2011 (as amended) for Technical Reasons. Spectral Laboratories Incorporated as the OEM owns key elements of the design of the air particle detectors, and the MOD does not possess sufficient rights to provide to any third party. In any event only Spectral Laboratories Incorporated has the bespoke technical know-how, technical expertise, equipment, and tooling required to perform the services and ensure the continued operational capability of the APD systems. Spectral Laboratories Incorporated is the only Supplier with the required customised facilities and testing capabilities that are compliant with the relevant UK safety regulations to ensure fleet operations are maintained.
