This contract has been awarded under the urgent circumstances provision of the Provider Selection Regime (PSR). This contract has been awarded under the Health Care Services (Provider Selection Regime) Regulations 2023. For the avoidance of doubt, the provisions of the Public Contracts Regulations 2015 do not apply to this award.<br/><br/>This is an Urgent Award due to severe capacity issues in the service resulting from two consultant vacancies that the Trust has been unable to fill combined with a forced closure of a treatment room and subsequent reduction to theatre lists. Efforts to find staff to fill these gaps have been unsuccessful and the additional capacity problems caused by the closure of the treatment room has compounded the issues of providing timely, safe treatment of patients.<br/><br/>The contract award decision was made by the Chief Executive and Interim Chief Financial Officer.<br/><br/>A potential conflict of interest has been recorded as some surgical staff of the provider are also employed by the Trust. No such staff were involved in the decision to award the contract. To address potential conflicts of interest all staff within the Trust are asked to complete conflict of interest forms and secondary employment forms where applicable. These are held on a register which is monitored by the Audit and Risk Governance Committee and managed by the Information governance and Human Resources departments.
