Abstract

The purpose of the clear and clean Framework Agreement is to bring Fife Council housing stock, hostels and Gypsy traveller sites back to their original standard with regard to cleanliness and general maintenance after a Council tenant or homeless person moves on to alternative accommodation, to allow the property to be re-let. This includes general clearance of large items and rubbish, deep cleaning, and trauma cleaning. As well as clear and clean services, the requirement may also extend to minor repairs, a garden tidy, emptying of bins, stair cleaning, pest control, and sharps removal.

TUPE – The Transfer of Undertakings (Protection of Employment) Regulations 2006 give effect to the EC Acquired Rights Directive 1977. Tenderers should note that TUPE may or may not apply to some or all of the personnel currently assigned to undertakings that are currently performing part or all of the duties described in the Tender Specification. Tenderers should, prior to submitting their tender, take their own specific legal advice to ascertain whether TUPE could be held to apply to such undertakings and, if so, how that would impact on their tender. The Council is not able to advise tenderers upon the effect of the TUPE Regulations.

If Tenderers consider TUPE does apply, Tenderers should contact the incumbent contractor/supplier to obtain the required specific and necessary information about the personnel currently employed in providing the services that are the subject of this tendering exercise.
