The procurement falls outside the scope of application of the Directive
Explanation
This call off contract has been awarded as a direct award call‑off under an existing framework agreement in accordance with Regulation 33 of the Public Contracts Regulations 2015.
The framework was established following a compliant process, and the framework terms expressly permit the use of a direct award where the contracting authority's requirements can be met by a supplier without reopening competition.
As the framework rules included a direct award mechanism and the conditions for direct award were satisfied, no prior publication of a call for competition was required. The award of this call‑off contract is therefore lawful and compliant with the provisions governing the use of framework agreements under the Public Contracts Regulations 2015.
