Description of how these justifications apply

It is the MoD’s intention to place a Contract with BAES to mitigate the risk of discontinuity of service from 1st April 2026. The estimated duration and value is four years with an approximate value of £6.4M (ex VAT).

It is considered that this contract can be placed under Section 41 (Direct Award), in accordance with Schedule 5, Para 6 of the Procurement Act 2023 due to an absence of competition for technical reasons. This is because BAE Systems (Operations) Ltd (BAES) is the only company to have access to the Hawk TMk1 aircraft data packs and other technical information that is necessary to supply the Authority with an accurate replica of the Hawk T Mk1 aircraft for the use of synthetic training for all RAF user groups. UK RAF require the use of high-fidelity synthetic training devices to ensure suitably trained staff for safe, effective and efficient operational delivery Without access to the data packs and other technical information no other contractor would be able to fulfil this requirement, therefore BAES are the only contractor that can fulfil this requirement.
