with the strict conditions stated in the Directive.
g)Service contract awarded to the successful candidate or one of them after a design contest.
h) For supplies quoted and purchased on a commodity market.
i) For the purchase of supplies on particularly advantageous terms:

from the receivers or liquidators of a bankruptcy, an arrangement with creditors or a similar procedure. |
j) All tenders submitted in reply to an open procedure, a restricted procedure or competitive dialogue were irregular or
unacceptable. Only those tenderers were included in the negotiations which have satisfied the qualitative selection criteria.
Other justification for the award of the contract without prior publication of a
contract notice in the OJEU:
k) The contract has as its object services listed in Annex B of Directive 2004/18/EC or in Annex XVII B of Directive 2004/17/EC
l) The contract falls outside the scope of application of the relevant directive.
In addition to the box(es) ticked above please explain in a clear and
comprehensive manner why the award of the contract without prior publication of
a contract notice in the OJEU is lawful, stating in any case the relevant facts,
and, as appropriate, the conclusions of law in accordance with the articles in
the relevant Directive (500 words maximum):
Bedford Custody unit has closed on the decision of the Police & Crime Commissioner and the Chief Constable due to a HM Inspectorate of Constabulary report. Detainees are being transferred from Bedford area to the Dunstable custody unit at considerable cost and reduction in operational capability. We have contacted possible suppliers but we can find only one supplier with an existing custody unit for hire. We are considering this to be an emergency and are looking for a two year hire while we tender for a permanent custody unit.The cells are Lambeth cell design and we required an example of the finished product for inspection prior to placing an order due to the urgent situation and to ensure compliance with the code of practice or any commitment on our part. The hire is for an 18 cell temporary custody suite and a standalone 16'x9' holding cabin. The building includes the following support/process areas; charge area with twin booking in desks, staff support office, staff toilets, medical room, process rooms, interview rooms, shower, cleaners store and kitchen facility. It also includes a CCTV system, alarm strips and system, access control system and the suite is fully compliant with the current code of practice for safe detention. The hire agreement includes installation and removal after the hire period has been completed.
