Southend University Hospital NHS Foundation Trust acting as lead Trust in partnership with NOE CPC on behalf of NHS Direct Stationery Consortium are looking for a sole supplier to provide a "one-stop-shop" for Office Equipment, Consumables and Associated Services.

Southend University Hospital NHS Foundation Trust and NOE CPC wish to establish a Framework Agreement for use by the following UK organisations/bodies (and any future successors to these organisations) subject to the approval of the lead Trust, Southend University Hospital NHS Foundation Trust and /or NOE CPC.

The value provided in Section II 1.4 is only an estimate. We cannot guarantee to the successful supplier any business through this framework agreement. Spend and volumes may vary throughout the life of the framework agreement from the anticipated levels given in this notice. However historic value of spend over the past 12 months prior to the issue of this advert equates to 10,000,000 GBP based on a smaller product range

The Trust does not bind itself to accept the lowest offer or any offer and reserves the right to accept an offer in whole or part, each item for this purpose being treated as separate.

The Trust can not be held responsible for any costs incurred by Offerors in relation to the preparation of their offer and any post offer clarification.

The Trust undertakes to use its best endeavours to hold confident any information provided in any proposal submitted, subject to the Trust's obligation under law, including the Freedom of Information Act 1997. If the applicant considers that any information submitted in any proposal should not be disclosed because of its sensitivity then this should be stated with the reason(s) for considering it so.

Lodging of appeals

Southend University Hospital NHS Foundation Trust will incorporate a minimum of 10 calendar days standstill period at the point information of the award of contact is communicated to tenderers. This period allows unsuccessful tenderers to seek further debriefing from the contracting authority before the contract is entered into.

Applicants have two working days from the notification of the award decision to request additional debriefing and that information has to be provided a minimum of 3 working days before the expiry of the standstill period.

Such additional information should be requested from the contact in part 1.1 of this advert.

If an appeal regarding the award of the contract has not been successfully resolved the Public Contracts Regulation 2006 (SI 2006 No5) provide for the aggrieved parties who have been harmed or at risk of harm by a breech of the rules to take action in the High Court (England, Wales or Northern Ireland. Any such action must be brought promptly (generally within 3 months). Where a contract has not been entered into the court may order the setting aside of the award decision or order the authority to amend any document and may award damages. If the contract has been entered into the Court may only award damages (the purpose of the standstill period referred to allows the parties to apply to the courts to set aside the award decision before the contract is entered into)
