The basis for Disclosure Scotland's use of the negotiated procedure without prior publication of a contract notice is Regulation 14 (1)(a)(iv)(cc) of the Public Contracts Scotland Regulations 2012, (namely extreme urgency).
Disclosure Scotland awarded a call-off contract to an incoming economic operator, under a framework set up in accordance with Directive 2004/18/EC, and faced unforeseen circumstances that prevented completion of that contract. Since service mobilisation and delivery by that incoming economic operator could not take place, this award is made to the incumbent contractor (being the only economic operator able to maintain service continuity).
Disclosure Scotland faced extremely grave jeopardy in terms of the potential failure of business critical operations beyond 29.4.2015, which require to be provided to the public without fail on a continuing basis.
The contract awarded is appropriately limited in duration having regard for the urgency, and corresponds to the time-scale assessed as required to run a fresh compliant public procurement process and to allow for safe and successful transition and mobilisation.
The new procurement procedure is expected to be advertised shortly.
