Justification for selected award procedure:
The works, supplies or services can be provided only by a particular economic operator for the following reason: protection of exclusive rights, including intellectual property rights
Explanation:
Ship Acquisition, which is part of the UK Ministry of Defence (MOD), proposes to place a contract with Wartsila France S.A.S.UK (‘the Company’) for the provision of a Diesel Engine to be used for training for the Queen Elizabeth (QE) Class Aircraft Carriers (the ‘Contract’).
The Contract covers the supply of equipment for a shore-based training facility to replicate the on-board Diesel Engine (‘the On-board System’) comprising of Wartsila Diesel Engine Type 4L20, FAKS (QEC diagnostic system) interfacing with a Modbuswoodward 723 controller, FAKS (QEC diagnostic system) and interface for Modbus TCP communication and control system (such replica training equipment and system being the (‘Replica Training System’) with an estimated value of 500 000 GBP and a duration of 1 (one) year.
It is considered that this contract can be placed using the negotiated procedure without prior publication of a contract notice pursuant to Article 28(1)(e) of Directive 2009/81/EC of the European Parliament and of the Council
and Regulation 16(1)(a)(ii) of the Defence and Security Public Contracts Regulations 2011 (SI 2011/1848) on the basis that the diesel engine can be supplied only by the Company for technical reasons. The Company has access to proprietary know-how and expertise in relation to the existing On-Board System and is alone able to meet the MOD's requirement for the prompt delivery of the Replica Training System with technical performance and behavioural characteristics matching those of the On-Board System and so enabling high fidelity training to be provided without material risk to the Carrier's operations and safety.
