This contract is for the support and maintenance and database administration of the Council's Revenues and Benefits IT system. The Council has license in perpetuity for the software to carry out its Revenue and Benefits functions. This Contract is for the support, maintenance and associated database administration of this software. As the Council has license to this software in perpetuity, the licenses are considered council assets and therefore the award of this contract has been made under Regulation 32 (2) (b) of the Public Contract Regulations 2015.

Explanation
Kingston Council owns a perpetual licence for the use of a Northgate Revenues and Benefits IT Software application and has a licence for an associated Oracle database. The application and the database are Council assets that require support and maintenance. Northgate owns the Intellectual Property Rights (IPRs) for the software application and has not licensed them to third party maintainers. Therefore Northgate is the only provider of maintenance for the application and, such is the inter-dependency between the application and the database, that the database has also to be supported by Northgate.
