— Reg. 33(1)(b)(ii): competition is absent for technical reasons (only if it is not caused by artificial narrowing down of the parameters of the procurement and no reasonable alternative or substitute exists),

IV.1) Description
IV.1.1) Type of procedure
Award of a contract without prior publication of a call for competition
Justification for selected award procedure:
The works, supplies or services can be provided only by a particular economic operator for the following reason: absence of competition for technical reasons
Explanation
Reg. 33(1)(b)(ii): Hewlett Packard Enterprise are the only possible source for maintenance due to exclusive rights for the HPE 8600 system installed in the advanced computing facility and operated by the University of Edinburgh under grant funding for the Science and Technology Facilities Council, and which was competitively procured under the SSSNA framework MT0768 in 2018 and upgraded in Jan 2019.
Reg. 33(4)(b): integrating a hierarchical storage manager (HSM) with the existing HPE provided file system could only be supported by HPE, without risk of compatibility issues and disproportionate technical difficulties since HPE would not support tightly coupled use of their file system with another vendor’s products.
