Justification for selected award procedure:
No tenders or no suitable tenders/requests to participate in response to open procedure
Explanation
No suitable tenders were received through the Open procedure. Regulation 32 of the Public Contract Regulations 2015 allows Contracting Authorities to enter in the negotiated procedure without prior publication in such cases. One bid was received to the original open procedure, but this bid was heavily qualified and the Council could not accept it. The Council exercised its right to enter into the negotiated procedure without prior publication, and conducted negotiations with the sole bidder. Terms were agreed that were not substantially altered from the initial conditions of the contract as required under Regulation 32.
