IV.1) Description

Justification for selected award procedure:
The procurement falls outside the scope of application of the Directive
Explanation:
The Authority will be purchasing the OEM launch and recovery system (LARS) for the Remus 600 UUV, along with two replacement “autonomy processor units” required for the Remus 600 UUV, under PCR 2015, using standardised contracting template 2 (SC2). An existing single source contract with Hydroid was held by the Authority but has recently expired leaving no other means of procuring from the OEM, Hydroid, other than placing a contract with them directly for the required equipment.
The fully automated version of the R600 LARS and processor units are required due to the systems being required to work as part of autonomous systems on-board an unmanned vessel and the only autonomous system currently available is through the system OEM Hydroid.
Hydroid’s footprint in the UK is Hydroid Inc and they can provide the system directly to the Authority.
The Hydroid LARS and processor units are proprietary equipment, with exclusive IPR rights owned Hydroid and offers unparalleled interoperability with the existing Remus 600 UUV produced by Hydroid and other Hydroid equipment that the Authority own and require for this programme and meets the requirement for standardisation of equipment in defence and security. In addition to owning the IPR on the autonomy processors, they must be fitted by Hydroid to maintain warranty on the equipment.
Regulation 32 part B provides justification for single source approval under PCR 2015 due to exclusive rights of the equipment as the autonomous LARS and autonomy processor units for the Remus 600 UUV is OEM equipment only available through Hydroid.
Exemption under this section of Regulation 32 only applies if the equipment the Authority intends to purchase is proprietary equipment and there are no other compatible with the current system alternative currently available for both items the Authority requires.
MHC, is part of the UK Ministry of Defence (“MoD”), intends to award a contract to HYDROID Inc to procure OEM Automated Launch and Recover System (LARS) and ancillaries for the Remus 600 UUV.
It is considered that this contract can be placed using the negotiated procedure without prior publication of a contract notice pursuant to Article 32(2)(b)(ii) of Directive 2014/24/EU (Regulation 32(2)(b)(ii) of the UK Public Contract Regulations) because competition is absent for technical reasons. This is because the equipment required is proprietary to the OEM of the UUV”.
