This Agreement between Hampshire County Council and Network Rail is required to facilitate inspections and maintenance of bridges over the railway lines which are owned by the local authority.
Services are undertaken in terms of bespoke Basic Asset Protection Agreements (BAPA’s). These Agreements are produced and agreed between the 2 parties before each job is undertaken. This enables the Authority to carry out inspections and maintenance of bridges over the railway which are owned by the Authority.
This contract has been awarded for a period of 3 years until 24.6.2022.

Justification for selected award procedure:
The works, supplies or services can be provided only by a particular economic operator for the following reason: absence of competition for technical reasons
Explanation
There is no other supplier the Authority can approach for these services. There is provision for justification under Regulation 32(2)(b) of the Public Contract Regulations 2015, as follows, of which sections (ii) and (iii) will apply:
32(2)(b) where the works, supplies or services can be supplied only by a particular economic operator for any of the following reasons: (ii) competition is absent for technical reasons;
(iii) the protection of exclusive rights, including intellectual property rights, but only, in the case of paragraphs (ii) and (iii), where no reasonable alternative or substitute exists and the absence of competition is not the result of an artificial narrowing down of the parameters of the procurement.
