Section IV: Procedure
IV.1) Description
IV.1.1) Type of procedure
Award of a contract without prior publication of a call for competition
Justification for selected award procedure:
The works, supplies or services can be provided only by a particular economic operator for the following reason: absence of competition for technical reasons
Explanation
The value of this Direct Award Contract (DAC) i.e 197 000 GBP is above the EU threshold and therefore the Public Contracts Regulations 2015 apply. There are derogations under the regulations to award a contract to a single supplier where competition is absent for technical reasons (Regulation 32(2)(b)(ii) but only where no reasonable alternative or substitute exists and the absence of competition is not the result of an artificial narrowing down of the parameters of the procurement.
On the basis of the information presented, it may be possible to rely on a derogation in this case (i.e. 32(2)(b) (ii)) as the support and maintenance can only be purchased from Oracle.
