Justification for selected award procedure:
The works, supplies or services can be provided only by a particular economic operator for the following reason: absence of competition for technical reasons
Explanation:
Babcock DSG Ltd, acting as agent for the UK Ministry of Defence, intends to negotiate a contract with Firemark Ltd (‘the Contractor’) for the supply of Fire Suppression Systems (Systems) used on Armoured Fighting Vehicle (AFV) Platforms. It is considered that this contract can be placed using the negotiated procedure without prior publication of a contract notice pursuant to article 28(1)(e) of Directive 2009/81/EC (Regulation 16(1)(a)(ii) of the Defence and Security Public Contracts Regulations 2011) for technical reasons. This is because only the contractor, as the Original equipment manufacturer for the units has access to the technical specifications, design and technical information, expertise, knowledge and know-how necessary to manufacture the systems to the required build standard and, as the systems are safety critical to both the safety of the platform and the crew, the Systems must be manufactured in accordance with the relevant technical specifications in order to meet safety requirements.
