IV.1) Description

IV.1.1) Type of procedure

Award of a contract without prior publication of a call for competition

Justification for selected award procedure:

The works, supplies or services can be provided only by a particular economic operator for the following reason: absence of competition for technical reasons

Explanation

The equipment covered came into service between the early 1970s and 1989 has been supported and maintained by Raytheon throughout its life. Only Raytheon has the knowledge, tooling and test equipment in place to continue supporting this equipment.

Pursuant to the Military Aviation Authority’s Regulatory Article 1005(2) ‘Design Organisations’ only a competent design organisation shall be contracted for PDS of Air Systems. Raytheon Systems Ltd are the only Design Approved Organization Scheme (DAOS) accredited design organisation for this equipment.

Due to the age of the equipment involved there are multiple obsolescence issues and additional obsolescence issues are highly likely over the remaining life of the equipment. The obsolescence issue must be rectified to ensure continued support to the Hawk and Tornado Platforms. Failure to do so would result in Aircraft being grounded. As a result, there is a specific safety requirement which must be fulfilled to ensure the safe functioning of the Armed Forces. Raytheon are the only economic operator that can maintain and provide PDS for the equipment as they are the only economic operator with the know-how, tools and means to meet the requirement.
