Justification for selected award procedure:
The works, supplies or services can be provided only by a particular economic operator for the following reason: absence of competition for technical reasons
Explanation:
The Chinook Project Team, part of the United Kingdom Ministry of Defence, intends to place a contract with TT Electronics Fairford Ltd (the Contractor) for the procurement of Chinook unique aircraft cabling (including mega-rupter cables) and associated spares. The contract has a term of 5 years and an estimated value of GBP 1.7 million (ex VAT).
It is considered that this contract may be placed using the negotiated procedure without prior publication of a contract notice pursuant to Article 28(1)(e) of Directive 2009/81/EC and Regulation 16(1)(a)(ii) of the Defence and Security Public Contracts Regulations 2011 (SI 1848) on the basis that for technical reasons the contract may be awarded only to the Contractor. The unique aircraft cabling and spares were previously designed and manufactured by TT Electronics-IMS. No other economic operator outside the Contractor’s group would be able to source and provide the items required under the contract in a manner that meets its requirements. Alternative provision would directly and adversely impact on Chinook airworthiness causing an unacceptable air safety risk.
