II.2.4) Description of the procurement
The requirement relates to the appointment of a suitably qualified managing agent to deliver the HEEPS: ABS into households in communities across Orkney. It is envisaged that the contract will comprise of the marketing and recruitment of participants, appointing suitably qualified energy surveyors, procuring, appointing and managing sub-contractors, installers and providing relevant data required to meet reporting obligations outlined by the Scottish Government HEEPS: ABS guidance.
The Council is looking to bid for a minimum of GBP 1 m per-year through the Scottish Government HEEPS: ABS programme. There is also the expectation that the winning tenderer will access additional funding from external sources over the five-year period of the contract. This will primarily come from ECO and the Council will provide an ECO Flexible Eligibility Statement of Intent to support the HEEPS: ABS programme. The Council will also be looking to bid for other funds including the Warm Homes Fund and may well look to deliver any successful funding bids via the HEEPS: ABS programme. Relevant bids will be developed alongside the winning tenderer

Orkney Islands Council reserves the right to cancel the procurement at any stage and not award a contract. The expenditure, work or effort undertaken by bidders prior to the award of any contract is accordingly a matter solely for the commercial judgement of bidders.
Late tenders will not be considered by the Council and all questions are to be submitted via the questions and answers section of this contract advertisement on PCS.
An economic operator that suffers, or risks suffering, loss or damage attributable to a breach of duty under the Public Contracts (Scotland) Regulations 2015 may bring proceedings in the Sheriff Court or Court of Session.

The amount of the award will be in accordance with the funding provided from Scottish Government — the GBP 8 million within the award is for evaluation purposes only.
