Explanation
direct award without prior publication under Regulation 32(2)(b)(ii) of the Public Contract Regulations 2015 if competition is absent for technical reasons; and under Regulation 32(2)(b)(iii) for the protection of exclusive rights, including intellectual.
Trane is the manufacturer of the chillers and has specialist knowledge and technical expertise to resolve mechanical, software and controls related issues (with exclusive access to manufacturer codes and passwords) to a degree that no other supplier has, minimising asset downtime and operational risk to the National Infrastructure (i.e. data centre) that depends on the service.
