The Association of North East Council Trading as the North East Procurement Organisation (NEPO) are seeking to establish a multi supplier framework agreement for the installation and operation of electric vehicle charging infrastructure on behalf of a public sector body under a call-off contractual arrangement. This framework and future call-offs are relevant for the installation of electric vehicle infrastructure and units. This can be provided by the public sector body themselves, a national Government department (such as LEVI/OZEV/Levelling Up), or via a third party intermediatory such as the North East Combined Authority.
NEPO is looking to award a procurement solution to assist the longer-term investment in the regional electric vehicle charging infrastructure (EVCI). This investment is needed to upgrade, operate, and maintain the current network and resource expansion to establish a sustainable long-term future.
The intention is to establish a multi-supplier Framework Agreement for use by NEPO Member Authorities and Associate Members.

II.2.4) Description of the procurement
The Council have opted to procure the NEPO232 EV charging Infrastructure Framework Contract under the Public Contracts Regulations 2015 (PCR15) competitive negotiated procedure. This procedure has been adopted due to the operational and commercial complexities of procuring such a Framework Contract. However, in accordance with the procedure, NEPO reserves the right to accept the initial Tender without further negotiation. Tenderers should note that any negotiation permitted is in the absolute discretion of NEPO.
The Council retains absolute discretion in deciding whether any changes will be implemented, and Tenderers should therefore be prepared to sign up to the tender as drafted.
Any resulting Framework Contract will consist of:
The Contract Particulars (to be filled in with the relevant details following Framework Contract award);
The Framework Agreement for EV Charging Infrastructure; and
The Invitation to Tender; and
The successful Tender documentation
The Framework Contract will be subject to English law and the exclusive jurisdiction of the English Courts.
Any Framework Contract award will be conditional on the Framework Contract being approved in accordance with the Council's internal procedures and the Council being generally able to proceed and will allow the standstill period of a minimum of 10 calendar days to elapse before sending confirmation of Framework Contract Award to the successful supplier.
The Council communicate through the Open e-tendering system; therefore, all correspondence regarding this Tender will be issued to the named person registered on Open. It is the Contractor's responsibility to ensure the correct named person is registered on Open.

A maximum of 15 tenderers will be shortlisted from this selection questionnaire process and invited to tender. If there are at least 15 suitably qualified tenderers that pass the minimum criteria. If there are less than 15 tenderers that pass the minimum criteria, then only those tenderers that pass will be invited to tender. If there are more than 15 tenderers that pass the minimum criteria, then the 15 highest scoring tenderers only will be invited to tender.
