IV.1) Description
IV.1.1) Type of procedure
Award of a contract without prior publication of a call for competition
Justification for selected award procedure:
The procurement falls outside the scope of application of the Directive
Explanation
The Council published a Contracts Finder notification to advertise the procurement which was viewed 727 times. The Council then proceeded to run a procurement for the opportunity under the open procedure.
While no formal call for competition was published, the Council has otherwise conducted the procurement in compliance with the PCR and the underlying Treaty principles of non-discrimination, transparency and proportionality. Given the large number of views to the Contracts Finder advert, it is clear that market operators actively search out and engage with potential opportunities to provide their services and the Council considers that the lack of a call for competition is not likely to have materially prejudiced competition. Therefore, the Council has entered into contract with the preferred bidder identified through the procurement process. Organisations who requested to participate but were unsuccessful have been informed of this fact and been provided with the information required under Regulation 86 of the PCR.
