Short description of the contract or purchase(s)
Lee Valley Regional Park Authority has a requirement for BMX Bike supplies at the Lee Valley VeloPark.
The Chosen Supplier will be required to supply BMX Bikes (Lot 4 - previous OJEU references 272587-2012 and 217905-2013) and additional BMX Bike purchases across the term of this Contract. Furthermore, it is a main requirement that the Authority will be able to purchase BMX Bikes of the same specification, or an improved specification, at the Contract price throughout the duration of the Contract.
In addition, the Chosen Supplier will be required to supply the ad hoc purchase of Spare Parts, which are fit for purpose and to the same specification or an improved specification, at the Contract price throughout the duration of the Contract.

Additional Information
The initial term of the Contract will be let for a 3 year period, with a provision for the Authority to extend the agreement at its discretion where it is satisfied with the Chosen Supplier's performance. If satisfactory performance has been delivered the Authority may extend the contract, annually, under the same contractual terms and conditions, for a further 2 years.

Annex D1 – General procurement
Justification for the award of the contract without prior publication of a contract notice in the Official Journal of the European Union (OJEU)

b) The products involved are manufactured purely for the purpose of research, experiment, study or
development under the conditions stated in the Directive (for supplies only).
c) The works/goods/services can be provided only by a particular tenderer for reasons that are:

Other justification for the award of the contract without prior publication of a
contract notice in the OJEU:
k) The contract has as its object services listed in Annex B of Directive 2004/18/EC or in Annex XVII B of Directive 2004/17/EC
l) The contract falls outside the scope of application of the relevant directive.
In addition to the box(es) ticked above please explain in a clear and
comprehensive manner why the award of the contract without prior publication of
a contract notice in the OJEU is lawful, stating in any case the relevant facts,
and, as appropriate, the conclusions of law in accordance with the articles in
the relevant Directive (500 words maximum):
The Authority did not receive any tenders for this Contract i.e. Lot 4 (Supply of BMX Bikes) in response to the Open procedure, OJEU contract notice reference 272587-2012.
Therefore, the Authority applied the negotiated procedure without prior publication of a contract notice (in accordance with the Public Contracts Regulations 2006 (SI 2006 No 5 - as amended), Regulation 14 (a) (ii)) to proceed with the award of this Contract.
