Justification for the choice of the negotiated procedure without prior call for competition

The contract was awarded to the provider due to the fact that the provider already provided data storage and management services for the CCGs under a contract with the Commissioning Support Unit. Following the decision by the CCGs to perform the contracting and provider performance management function in-house, the CCGs had planned to continue to commission the CSU to provide data warehousing functions. However, following significant discussion about how the service would be carried out and associated costs, it did not prove possible to come to a mutually satisfactory agreement with the required assurance of ability to deliver the set requirements. For that reason, and given the imminent termination of the contract with the CSU, the CCGs entered discussions with the Kent and Medway Health Informatics Service who already provided the services under a sub-contract with the CSU. Given the timescales involved it was not possible to engage in a competitive process as this would have hampered the CCGs' ability to carry out a number of their key functions. The contract was therefore awarded for a time-limited period allowing time to complete a full procurement process. The CCGs commit to launching a full procurement process during 2015.
