Justification for selected award procedure:
The works, supplies or services can be provided only by a particular economic operator for the following reason: absence of competition for technical reasons
Explanation:
The Defence General Munitions Project Team, part of the UK Ministry of Defence, intends to award a 1 year Contract to NAMMO Raufoss for the supply of MP / MPT / API (Multi Purpose / Multi Purpose Tracer / Armour Piercing Incendiary) Rounds L1A1 / L3A1 / L4A1. The value is 1 022 847.88 GBP Ex-VAT.
It is considered that this Contract can be placed using the Negotiated Procedure Without Prior Publication pursuant to Article 28(3) (a) of Directive 2009/81/EC (Regulations 16(1) (b) (i) of the Defence and Security Public Contracts Regulations 2011). The Contract can only be placed with NAMMO because these Rounds are in addition to existing Rounds and to obtain extra Rounds from a contractor other than the original contractor which supplied the existing Rounds would oblige the contracting authority to acquire Rounds having different technical characteristics which would result in incompatibility with the existing Rounds. Also, there would be disproportionate technical and logistical difficulties in the critical Operational output in relation to the existing Rounds because of variation in design of any alternative Round to meet current Operational capability requirements.
