The Council requires the provision of Service to receive and sort co-mingled dry recycling delivered by the Council, the transportation and delivery of the sorted material to processors and merchants, and the further sorting or final disposal of any non-recyclable or other unacceptable waste arising from the sorting process. The intention of the Service is to maximise the recovery of dry recycled materials to ensure the most financially advantageous position for the Council.

The Contractor will be required to process, recover, recycle and if necessary appropriately dispose of non-recyclable or other unacceptable waste materials arising from its collection of co-mingled recycling. Indicative volumes and types of recycling can be found within the invitation to tender documents.
The Council will generally deliver dry recycling to the specified delivery point using single bodied 26 tonne Dennis Eagle refuse collection vehicles.
To ensure operational efficiency and cost effectiveness, the Contractors proposed transfer station or processing facility to which the Council will deliver dry recycling must be no further than 25 miles from Merlin House, Quarry Hill Industrial Estate, Merlin Way, Ilkeston, DE7 4RA.
Indicative total contract value for maximum 7 year contract period is 1 500 000 GBP .

The Contract once awarded will, subject to ongoing satisfactory performance, remain in force for a period of 5 years. Thereafter the Council may, at its sole discretion, award 2 further extensions of up to 12 months each giving a total maximum term of 7 years. Any extension is subject to funding, business need and satisfactory performance.

List and brief description of conditions:
The Contractor shall ensure the receipt of dry recycling from the Council, the operation of delivery points for the purposes of transfer and/or processing, the loading and onward transportation of sorted material, the storage, loading and transportation of unacceptable waste for further treatment or final disposal, is carried out in strict accordance with all conditions imposed by the Environment Agency and any other UK regulatory body.
Evidence of valid/current permits, licenses, consents relating to the facilities receiving/processing dry recycling and to the transportation of material will be required to be submitted as part of the tender response.

Precise information on deadline(s) for review procedures:
Erewash Borough Council will incorporate a minimum 10 calendar days standstill period at the point information on the award of the contract is communicated to tenderers. This period allows unsuccessful tenderers to seek further debriefing from the contracting authority before the contract is entered into. Applicants have 2 working days from the notification of the award decision to request additional debriefing and that information has to be provided a minimum of 3 working days before the expiry of the standstill period. Such additional information should be required from the contact details provided in section I.1) of this notice. If an appeal regarding the award of a contract has not been successfully resolved the Public Contracts Regulations 2015 provide for aggrieved parties who have been harmed or are at risk of harm by a breach of the rules to take action in the High Court (England, Wales and Northern Ireland). Any such action must be brought promptly (generally within 3 months). Where a contract has not been entered into the Court may order the setting aside of the award decision or order the authority to amend any document and may award damages. If the contract has been entered into the Court may only award damages. The purpose of the standstill period referred to above is to allow parties to apply to the Courts to set aside the award decision before the contract is entered into.
