IV.1) Description
IV.1.1) Type of procedure

Justification for selected award procedure:
Extreme urgency brought about by events unforeseeable for the contracting authority and in accordance with the strict conditions stated in the Directive
Explanation
The North West Police Underwater Search and Marine Unit (NWPUSU) provides maritime operational policing to the entire North West and North Wales coast. The existing police boat ‘Consortium’, was involved in a collision whilst moored in Barrow Docks. This has resulted in significant damage after it was hit by a much larger commercial vessel. The boat is now out of service and the insurance process is underway for the resulting repairs. The timescales are currently unknown, however it is likely to be many months before the vessel is repaired, and it not known when or whether it will be suitable for operational use when these repairs are complete. The police boat is a regional asset that provides capability to police offshore incidents, and to provide security escorts for other specified vessels in order to protect them from waterborne threats. The maintenance of the police offshore operational capability must be reinstated as a matter of urgency. Options to use mutual aid from other police teams is not practical due to the distance and geographic area, plus the provision of the supplying force staff, and the lead times for new boats is also many months. The urgency of re-instating operational capability can only be met by a suitable vessel which is immediately available to enable it to be equipped for the police role and brought into operational use before the season for more inclement weather. Research of the used market has identified a suitable vessel that is immediately available and is for sale by The University of Liverpool. This boat meets the key essential and desirable traits (non GRP construction, twin hulled for better sea keeping, large deck space, manageable running costs, within the existing skillset of the marine police officers). The incident in Barrow Docks was unforeseeable and not attributable to the NWPUSU or Police and Crime Commissioner for Cheshire (on behalf of the Consortium) and in accordance with Regulation 32(2)(c ) and 32 (4) it is our intention to award a contract to The University of Liverpool for the purchase of their research vessel for 170 000 GBP, so that it can be commissioned and in service before the Autumn.
