IV.1) Description
  IV.1.1) Type of procedure
  Award of a contract without prior publication of a call for competition
  Justification for selected award procedure:
  The works, supplies or services can be provided only by a particular economic operator for the following reason: absence of competition for technical reasons
  Explanation
  1) The United Kingdom Ministry of Defence (the ‘Authority’) intends to place a new in-service support contract with Drumgrange Ltd (the ‘Company’) in order to support controlled reception pattern antenna (CRPA), precision fixing system (PFS) and NAVFIX. This will be made up of a single 5-year contract;
  2) The contract will continue to provide support under a contract for logistic support arrangement which will include spares and repairs support, maintenance and obsolescence management along with ad-hoc tasking. The total value for this new contract is 4 500 000 GBP;
  3) It is considered that this contract can be placed using the negotiated procedure without prior publication pursuant to Article 28(1)(e) of Directive 2009/81/EC and Section 16(1)(a)(ii) of the Defence and Security Public Contracts Regulations 2011 (SI 1848), on the basis that the contract may be awarded only to the Company for technical reasons.
  This is because:
  (a) it is technically impracticable for a supplier other than the Company to maintain and repair the equipment as specific know-how, extensive technical knowledge and maintenance history of the products and characteristics of the system(s) being maintained is required;
  (b) a fundamental safety management requirement is for the CRPA/PFS/NAVFIX systems to have a safety management system (SMS) at the highest (i.e. system) level to demonstrate how integration, functional management and changes at the sub-system or component level would be managed. As system designers, the Company is the only supplier able to perform this role;
  (b) the Company is also the technical authority and is the only supplier with the appropriate level of system configuration knowledge and suitably qualified and experienced personnel (SQEP) available to meet the requirement. Use of any third party support supplier would therefore present an unacceptably high risk of compromised safety management;
  (c) detailed design documentation and information is held by the Company for the proprietary equipment which is required for the performance of the contract due to the specialist nature of the system, its integration complexity with the RN vessels and time available before entry of the new capability.
