VII.2) Information about modifications
VII.2.1) Description of the modifications
This notice is published on a voluntary basis notwithstanding that neither the Concession Contracts Regulations 2016 nor the Public Contracts Regulations 2015 apply.
The Royal Parks (“TRP”) publishes this notice in order to record its intention to modify its contract for the provision of Event Management Services in relation to The Royal Parks Half Marathon, by extending its expiry date for twelve (12) months to 31 December 2022 and running a test event in April 2021 to assess social distancing measures and limitations.
In order to inform its decision, TRP undertook a market consultation exercise to assess the capability and the capacity of the marketplace. There was a significant lack of response to this exercise from event management companies.
VII.2.2) Reasons for modification
Need for modification brought about by circumstances which a diligent contracting authority/entity could not foresee
Description of the circumstances which rendered the modification necessary and explanation of the unforeseen nature of these circumstances:
COVID-19 constituted a Force Majeure event which due to the provisions of the contract caused the rescheduling of the event from October 2020, to October 2021 and automatically extended the contract by one year. Due to the unforeseeable impacts of COVID-19 and associated effects on mass participation sporting events, TRP has been unable to begin a procurement exercise to allow its completion by a date which would provide a new provider with an adequate mobilisation period to successfully deliver an event in October 2022. The extension is therefore required to allow the event to take place in October 2022. TRP intends to run a tender exercise in early to mid-2021 for Event Management Services from 2023 onwards. Notwithstanding TRP's position that neither the CCR 2016 nor the PCR 2015 apply, TRP believes that this modification would in any event be permissible under Regulation 43(1)(c) of the CCR 2016 (were those Regulations to be applicable).
