II.2.4) Description of the procurement
Onward Homes Ltd will enter into a contract with Anwyl Construction Company Ltd for a period of 98 weeks to undertake urgent groundworks, site remedial works, and completion of the development at Halton Court, Runcorn, consisting of 48 homes with effect from 23 November 2020. Upon receipt of professional advice from structural engineering consultants appointed by Onward Homes Ltd, the site requires the work undertaken urgently following the unforeseen events of the incumbent Cruden Construction entering into administration, leaving an outstanding programme of works and a major health and safety risk due to existing walls deteriorating and at risk of collapse, along with spoil mounds on-site which require removal/spreading to prevent immediate risk of landslide. The award of contract follows a previous VEAT Notice dispatched to OJEU on 2 October 2020.

Justification for selected award procedure:
Extreme urgency brought about by events unforeseeable for the contracting authority and in accordance with the strict conditions stated in the Directive
Explanation
Onward Homes Ltd requires the appointment of a contractor to undertake urgent groundworks and site remedial works to make the current development site safe. The conditions have been brought about unforeseeably to Onward Homes Ltd by the incumbent entering into administration which has left the remaining programme unfinished and following receipt of professional advice from structural engineering consultants appointed by Onward Homes Ltd, walls are deteriorating and could collapse, along with spoil mounds on-site which require removal/spreading and are causing a significant health and safety risk to residents nearby and other third parties. The risks are increased by the accepted adverse weather conditions which occur at this time of year. Due to the current status of the scheme design, and health and safety impact risk assessment, proceeding with an alternative procurement procedure in accordance with the Public Contract Regulations 2015 would cause significant delays to the appointment of a contractor and therefore a start on-site, hence rendering this impossible due to the significant impact on health and safety risk on-site. Furthermore Onward Homes Ltd has not been able to identify a compliant framework that offers part-completion of a site like this readily available to call off within the pressing timescales required.
