II.2.4) Description of the procurement
Cardiff & Vale University Health Board has a requirement to purchase a new Heart Lung Machine and Heater-Cooler Unit to enable essential cardiac surgery provision in 2nd Llandough Theatre.
A Heart Lung Machine (HLM) is an apparatus that does the work both of the heart (i.e., pumps blood) and the lungs (i.e., oxygenates the blood) during, for example, open-heart surgery. The basic function of the HLM is to oxygenate the body's venous supply of blood and then to pump it back into the arterial system. Blood returning to the heart is diverted through the machine before returning it to the arterial circulation. The HLM also provides intracardiac suction, filtration, and temperature control. Heater-cooler devices are used during cardiopulmonary bypass to help regulate the temperature of the patient's blood during cardiac, vascular or transplant surgery. They are an essential part of the equipment needed for these types of procedures.

Justification for selected award procedure:
The procurement falls outside the scope of application of the Directive
Explanation:
Livanova UK Limited are the Health Board’s current supplier for HLM’s. Sourcing a HLM/Heater-Cooler Unit from an alternative supplier would require in depth training. Secondly running 2 platforms across both University Hospital of Wales (UHW) and University Hospital Llandough (UHL) would be an unacceptable risk and incur additional costs due to product licenses for data management as well as multiple maintenance contracts for Procurement to manage. Furthermore staff are familiar with the operating the model of equipment, in turn providing continuity of care to patients living in the area of Cardiff & Vale Health Board.
Originally insufficient funds were available and as such the Health Board agreed to lease the equipment. As capital monies have now been allocated, this purchase will enable the department to own the current additional asset which is under the lease agreement and provide essential cardiac surgery in the 2nd Llandough Theatre.

Precise information on deadline(s) for review procedures:
NHS Wales Shared Services Partnership on behalf of Cardiff and Vale University Local Health Board will allow a minimum 10 calendar day standstill period between notifying the award decision and awarding the contract. Unsuccessful tenderers and applicants are entitled to receive reasons for the decision, including the characteristics and relative advantages of the winning bid and the reasons why the tenderer/applicant was unsuccessful. Should additional information be required it should be requested of the addressee in section I.1. Aggrieved parties who have been harmed or are at risk of harm by breach of the procurement rules have the right to take action in the High Court (England and Wales). Any such action is subject to strict time limits in accordance with the Public Contracts 2015 (Amendments).
