HS2 considers that the intended modification described in this notice is not substantial within the meaning of Regulation 88.7 of the Utilities Contracts Regulations 2016. In addition, this modification may fall into the category of modifications in Regulation 88.1(b) of the Utilities Contracts Regulations 2016 (and this has been noted in VII.2.2 below). In any event, HS2 considers that the intended modification falls within the scope of the original contract notice published in the Official Journal of the European Union and HS2 is therefore publishing this notice in the interests of completeness and transparency. HS2 reserves all its rights in respect of the reasons for this publication and whether it is legally obliged to publish such a notice.
All values given in this notice are approximate and the best estimates of HS2 at the time of publication of this Notice.
HS2’s decision to publish this notice does not constitute any waiver of any rights it may have or impose any further obligations on it in respect of any future contract modifications and the publication thereof.

VII.2) Information about modifications
VII.2.1) Description of the modifications
The new value of the contract in VII.1.6 is the estimated maximum new value, but the value of the additional work may range from nil to 38000000 GBP.
The purpose of the modification is to permit HS2 to instruct its Track Systems Contractors to procure slab track supplies for the tunnel sections of the current route through this contract rather than through their own supply arrangements.
Please note that the values in this notice are in relation to the core goods and services and exclude the optional services available to the Track Systems Contractors related to logistics. The value of optional services was originally 13000000 GBP in addition to the 260000000 GBP total contract value, and the estimated maximum new value of these optional services is 15000000 GBP in addition to the Total contract value after the modifications of 292000000 GBP; but the value of additional optional work may range from nil to 2000000 GBP.

Need for additional works, services or supplies by the original contractor/concessionaire
Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:
The new value of the contract in VII.1.6 is the estimated maximum new value, but the value of the additional work may range from nil to 38000000 GBP.
The purpose of the modification is to permit HS2 Ltd to instruct its Track Systems Contractors to procure additional slab track supplies through this contract for the tunnel sections of the current route rather than through their own supply arrangements.
