The procurement falls outside the scope of application of the Directive
Explanation:
PCR 2015 (regulation 32 (2)) outlines that a negotiated procedure without prior information may be used for public service contracts if - "it is strictly necessary where, for reasons of extreme urgency brought about by events unforeseeable by the contracting authority, the time limits for the open or restricted procedures or competitive procedures with negotiation cannot be complied"
BCCs incumbent supplier has entered administration, where BCC had no warning, this was beyond BCCs control, with a requirement for an immediate alternative provision. This meets the above regulation.
