Strategic Sealift provides UK Ministry of Defence (MOD) with a capability to deploy cargo overseas from the UK in support of the UK’s standing commitments and contingent operations. The current Sealift contract expires on 31 December 2024. A new project has been initiated by UK MOD, with the aim to provide a new contract for an interim period of minimum 7 years, to an updated user requirement. This is a VTN outlining the Authority's route to market.

Justification for selected award procedure:
The procurement falls outside the scope of application of the Directive
Explanation:
In accordance with regulation 4 of The Defence and Security Public Contracts (Amendment) (EU Exit)
Regulations 2019 (SI No.2019/697) this procurement falls to be regulated under the provisions of the
Defence and Security Public Contracts Regulations 2011 (DSPCR 2011) as amended (in particular by
SI 2019/697 and SI 2020/1450). Prior publication of a contract notice in the Official Journal of the
European Union is no longer appropriate. It is considered that this contract can be placed using the
negotiated procedure without prior publication of a contract notice in the UK e-notification service
(as required by the relevant legislation) and is lawful in accordance with regulation 16(1)(a)(ii) of the
DSCPR (2011) for technical reasons as Foreland Shipping Limited (“FSL”) is the only economic
operator that has vessels holding the required technical capability and capacity to support the
MOD’s Key User Requirements (KUR) detailed in a PIN published on Contracts Finder
