Jisc Services Ltd has incorporated a standstill period at the point information on the award of the contract is communicated to tenderers. That notification provided full information on the award decision. That standstill period, which was for a minimum of 10 calendar days, provided time for unsuccessful tenderers to challenge the award decision before the contract is entered into. The Public Contracts Regulations 2015 article 91 provides for aggrieved parties who have been harmed or are at risk of harm by a breach of the rules to take action in the

High Court (England, Wales and Northern Ireland).

VII.2) Information about modifications

VII.2.1) Description of the modifications

We have extended for a period of 8 months to allow for the re-procurement of this framework, following an abandonment decision in November 2023.

VII.2.2) Reasons for modification

Need for modification brought about by circumstances which a diligent contracting authority/entity could not foresee

Description of the circumstances which rendered the modification necessary and explanation of the unforeseen nature of these circumstances:

Modification need brought about by the time taken to run procurement (Proc2023/ 019/S 010-018219) and then the sudden abandonment of the retendering process. The award of the Network equipment and security framework (Proc2023) was formally done 12/09/23; all bidders were informed of their respective outcomes. Following the commencement of the standstill period Jisc received queries bidders citing concerns. Jisc took some time to analyse and understand the questions raised by bidders and concluded that whilst the ITT was structured and based on objective grounds, some elements resulted in potentially unreasonable results. After careful consideration, Jisc made use of the right reserved for itself in its ITT (Proc2023) to not award a contract to any of the bidders, and to abandon this procurement process. The extension under existing terms is to ensure stability for Jisc’s member organisations (see Section II.2.4, 2020/S 017-036340) whilst a retender is completed.
