II.2.4) Description of the procurement
The Scottish Fire and Rescue Service requires the execution of Asbestos Medicals in respect of all of its operational staff. Firefighters are classed as ‘licensed workers’ under the Control of Asbestos Regulations 2012 (CAR 12). This means they are required, by law, to undergo medical surveillance with a Health and Safety Executive (HSE) appointed doctor, every three years.
This will require the delivery of circa 6000 operational employees on a rolling three-year programme (i.e. 2000 medicals per year carrying out seven medicals per day). As such, the Service intends to implement a Framework Agreement involving all HSE Registered Doctors who provide a compliant response to the Service’s Statement of Requirements.

Precise information on deadline(s) for review procedures:
The Scottish Fire and Rescue Service (SFRS) must, by notice in writing as soon as possible after the decision has been made, inform all tenderers and candidates of its decision to award the contract, conclude the framework agreement or establish a dynamic purchasing system. The SFRS is obliged to comply with the regulations and any eligible economic operator can bring an action in the Sheriff Court or the Court of Session where as a consequence of a breach by the SFRS, they suffer or risk suffering loss or damage. The bringing of court proceedings and the remedies that are available to the courts are detailed in the regulations.
