Justification for the choice of the negotiated procedure without prior publication of a contract notice in the OJEU in accordance with art. 28 of Directive 2009/81/EC

a)	No tenders or no appropriate tenders in response to:
	restricted procedure negotiated procedure with prior publication of a contract notice competitive dialogue
b)	All tenders submitted in reply to a restricted procedure, negotiated procedure with prior publication of a contract notice or competitive dialogue were irregular or inacceptable. Only those tenderers were included in the negotiations which have satisfied the qualitative selection criteria.

c)	The periods for the restricted procedure and the negotiated procedure with prior publication of a contract notice are incompatible with the urgency resulting from a crisis.

d)	Extreme urgency brought about by events unforeseeable by the contracting authority/entity and in accordance with the strict conditions stated in the relevant Directive.

e)	The works/goods/services can be provided only by a particular tenderer for reasons that are:
	technical connected with the protection of exclusive rights.
f)	The contract concerns research and development services other than those referred to in Article 13 of Directive 2009/81/EC. (for services and supplies only)

Other justification for the award of the contract without prior publication of a contract notice in the OJEU:
The contract has as its object services listed in Annex II B to the Directive. The contract falls outside the scope of application of the Directive.
In addition to the box(es) ticked above please explain in a clear and comprehensive manner why the award of the contract without prior publication of a contract notice in the OJEU is lawful, stating in any case the relevant facts, and, as appropriate, the conclusions of law in accordance with the articles in the relevant Directive (500 words maximum):
Babcock Land Defence Limited (BLDL), acting as Agent for the Ministry of Defence (MOD) has awarded a Single Source Contract to Hall and Watts Defence Optics Ltd for the Supply of C2A2 Sight Spares and Associated Items, for a duration of 3 years with 2 x 1 Option Years. In accordance with regulation 4 of the Defence and Security Public Contracts (Amendment) (EU Exit) Regulations 2019 (SI 2019/697) this procurement falls to be regulated under the provisions of the Defence and Security Public Contracts Regulations 2011 as amended (in particular by SI 2019/697 and SI 2020/1450). Prior publication of a contract notice in the Official Journal of the European Union is no longer appropriate. It is considered that the award of the contract without prior publication of a contract notice in the UK e-notification service (as required by the relevant legislation) is lawful in accordance with Regulation 16(1)(a)(ii) of the DSPCR 2011 for technical reasons. This is because Hall and Watts Defence Optics Ltd is the only Contractor with significant niche expertise, technical ‘know-how’ and acquired specific experience to source quality spares and manage the supply chain / delivery process for this requirement. Hall and Watts Defence Optics Ltd is the manufacturer and sole distributor of spares to support the components required to support the C2A2 Platform. They own the rights to the technical specifications required to undertake the manufacture, testing and supply and they do not share this knowledge/expertise with any third party. This notice is not a request for expressions of interest so please do not apply to be invited to tender. Babcock Land Defence Limited intends to negotiate a single source Contract with the named supplier Hall and Walls Optics Ltd. Babcock Land Defence Limited is acting as Agent on behalf of the Ministry of Defence. In the first instance interested parties may contact Babcock with queries relating to this procurement.
