Short description of the contract or purchase(s)
The Trust has some 200 residential units on its Leighton site, all built in the early 1970's. The accommodation cannot be adapted to meet Deanery standards and therefore the accommodation needs to be reprovided. Of the current 200 units, some 100 units are currently used sub-optimally for office accommodation and a separate scheme is currently attempting to repatriate these offices back onto the main hospital site.
The Trust now wish to procure the design, build, funding and operation of approximately 100 bed spaces for their staff and other key workers to rent at Leighton Hospital as part of a nominations agreement there is a need to maintain 100 units during construction and therefore the phasing of new-build will be an important factor.
The Trust has already soft market tested providers of key worker housing and expresses a preference for having single en-suite rooms with three-quarter beds. It envisages the accommodation would be a ‘step-up' from student accommodation but a ‘step-down' from normal housing, having some shared areas.
Also, during soft marketing, it became clear that there were different models of hard and soft FM supply dependant upon supplier preferences and what arrangements were currently in place for the providers existing portfolio. It is equally clear that the accommodation needs to comply with current and predictable future deanery standards and also be offered at an acceptable market rent. It is predominantly this issue which is leading the trust towards a Competitive Dialogue procedure as it cannot readily predict what the financial model will look like.
It is therefore intended to use the Competitive Dialogue route in order to obtain the best value for the Trust and in order to ensure that this is achieved the Trust will retain the option to negotiate with at least two bidders until contract signature.
The anticipated contract period for this procurement exercise is 240 months with the Trust holding the option to possibly reduce or increase this period. However all options concerning potential contract periods will be discussed in further detail with suitably selected bidders at the Dialogue phase of the exercise.

Lodging of appeals
This authority will incorporate a minimum 10 calendar day standstill period at the point information on the award of the contract is communicated to tenderers, this period allows unsuccessful tenderers to seek further debriefing from the contracting authority before the contract is entered into. Applicants have two working days from notification of the award decision to request additional debriefing, this information has to be provided a minimum of 3 working days before expiry of the standstill period. Such additional information should be requested from the address in section I.1).
If an appeal regarding the award of a contract has not been successfully resolved the (for Public Sector) Public Contracts Regulations 2006 (SI 2006 No 5) provide for aggrieved parties who have been harmed or are at risk of harm by a breach of the rules to take action in the High Court (England, Wales and Northern Ireland), any such action must be brought promptly (generally within 3 months). Where a contract has not been entered into the court may order the settling aside of the award decision or order the authority to amend any document and may award damages, if the contract has been entered into the court may only award damages.
