NEPO is a Central Purchasing Body as defined in the Public Contract Regulations 2015 (PCR15). This means that NEPO may provide central purchasing activity on behalf of Contracting Authorities. The agreement will be available for use by all NEPO Members. This is a Framework Contract for the Provision and Distribution of Food and General Provisions to NEPO Member Authorities and potentially Associate Members or public bodies within the UK. This Framework Contract will operate with a core list of products with all other items offered at a discounted price. The tender is separated in to four lots which are:

Lot 1 — General Provisions and Alcohol

Lot 2 — Frozen Food

Lot 3 — Meat, Sausage and Poultry

Lot 4 — Fruit & Vegetables, Bread and Eggs.

Tenderers were invited to submit bids for 1 or more Lots.

Additional Information

The Framework Contract has been established as a ranked list, within each Lot, whereby the Contracting Authority will issue a Call — Off Order directly from the first ranked Contractor that can fully meet their requirements without re-opening competition. Contractors appear in this notice in order of their ranking for each Lot based on the outcome of the Award Questionnaire evaluation and pricing evaluation with the highest ranked being the bidder with the highest score.

If the first ranked Contractor notified the Council that it is no longer able to supply under the Framework Contract, or if the first ranked Contractor is unable to fulfill a Contracting Authorities full requirements, or the Council does not agree a price variation in accordance with clause 1.14 of the Special Terms and Conditions the Contracting Authority may then place an order directly with the next ranked Contractor on the Framework who can fully meet their requirements.

Alternatively, the Council may, if it chooses, re-open competition for that lot under the Framework, adhering to the Public Contracts Regulations 2015 for re-opening competition. The further competition will be run by inviting all successful Contractors to complete a further competition tender document, which will then be evaluated by officers using the same criteria as used to establish the Framework Agreement.
