Justification for selected award procedure:
The works, supplies or services can be provided only by a particular economic operator for the following reason: absence of competition for technical reasons
Explanation:
The Fast Air Support Team (FAST) Project Team, as part of the UK Ministry of Defence (‘MoD’), intends to award a contract to Ferrets Incorporated Limited for the Active Electonically Sourced Array (AESA) Technical Assessment Team (ATAT).
It is considered that a Contract will be awarded using the negotiated procedure without prior publication of a contract notice in accordance with Article 28 (1)(e) of Directive 2009/81/EC (Regulation 16 (1)(a)(ii) of the UK Defence and Security Public Contract Regulations 2011) for technical reasons. This is because they have a proven background in providing technical expertise into Airborne Radar related projects and are the only supplier capable of meeting all of the requirements expected of them. Given the high profile nature of the programme and Secretary of State input, awarding this requirement to any economic operator who does not meet the full set of required knowledge/background has been deemed to be unacceptable.
