IV.1) Description
IV.1.1) Type of procedure
Award of a contract without prior publication of a call for competition
Justification for selected award procedure:
The works, supplies or services can be provided only by a particular economic operator for the following reason: protection of exclusive rights, including intellectual property rights
Explanation
The Intellectual Property Rights of the equipment being maintained and serviced rests with ABB Ltd therefore it is not possible to compete this maintenance requirement in line with Directive 2014/24/EU of the European Parliament and of the Council. Due to technical reasons to introduce a new supplier would have a disproportionate cost as existing equipment would need to be replaced. This would also require plants to cease operations for a considerable length of time whilst the equipment was replaced therefore temporarily stopping the high hazard risk reduction activities performed at Sellafield Ltd.
