No tenders or no suitable tenders/requests to participate in response to open procedure
Explanation
Para 32 (5b) sets out that “a negotiated procedure without prior publication may be used for public supply contracts for additional deliveries by the original supplier which are intended either as a partial replacement of supplies or installations or as the extension of existing supplies or installations where a change of supplier would oblige the Contracting Authority to acquire supplies having different technical characteristics which would result in incompatibility or disproportionate technical difficulties in operation and maintenance”.
The licences purchased under this agreement sit under an OMA between the CPS and oracle, which expires in June 2020. The licences purchased are for continued use within a CPS business critical operating system. The purchasing of these licences therefore constitutes a replacement of supplies. A change of supplier (to an alternative manufacturer) would oblige the CPS to acquire supplies having different technical characteristics resulting in incompatibility or disproportionate technical difficulties in operation and maintenance.
