VI.3) Additional information
The services contracts are split into 2 Lots, targeting different groups of learners, which align with ESF Priority Axis 1 and ESF Priority Axis 2 respectively. The 2 priority groups have different eligibility criteria as well as associated outputs and results. Interested providers can bid against one or both Lots. Bids will be evaluated on a per Lot basis and will have a separate ranking for each Lot. Contracts will be awarded by ranking until the budget for the relevant Lot has been exhausted. An organisation may be awarded contracts to deliver services in one or both lots (and in respect of the latter, may be through a single contract). All contracts are due to commence on 1. 8. 2019.
The services to which this contract notice relates are “light touch” services under Regulations 74-77 of the Public Contracts Regulations 2015 (PCR). The GLA has identified use of the Open Procedure in Section IV.1.1 but is not following a fully regulated procurement process under Part 2, Chapter 2 of PCR. Details of the process (which requires submission of a selection questionnaire and tender at the same time by the deadline in Section IV.2.2) together with evaluation criteria and details of how contracts will be awarded are set out in the procurement documents available via the link in Section I.3 [Please note that the Transfer of Undertakings (Protection of Employment) Regulations 2006 (as amended) may apply to the award of contracts to which this notice relates.] A limited amount of flexibility in the eligibility criteria for each Lot has been introduced to allow for minor differences between AEB and ESF eligibility definitions and evidence requirements. Providers awarded contracts through this procurement, will be able to provide services to and claim funding for up to 10 % of learners within each Lot allocation who do not meet all of the ESF Priority Axis eligibility criteria for that Lot but do meet the other eligibility criteria, as specified in GLA AEB Funding and Performance Management Rules for Procured Providers.
The figure set out in Section II.1.5 which has been used to calculate the estimated values of the individual Lots at Sections II.2.6) is an estimate only based on GLA’s indicative budget and, as highlighted in Section I.1.4, is subject to final confirmation from the DFE. The split in values between Lots 1 and 2 is an estimate only and reflects the GLA’s current understanding of the extent of service provision under the 2 Lots. Payments made for service delivery under awarded contracts will be used as match funding to draw down European Social Fund (ESF) for a complementary programme of activities to support people who are in low-paid work to progress into better paid, higher skilled or more sustainable employment. All contracts awarded pursuant to this procurement and services delivered under such contracts will therefore need to be compliant with the ESF rules and regulations. Further information on the relevant ESF requirements is available in the procurement documentation.
The GLA reserves the right not to award any contract and to make whatever changes it sees fit to the timetable, structure and/or content of the procurement process and to cancel the process in its entirety at any stage. In such circumstances, the GLA will not reimburse any expenses incurred by any person in the consideration of and/or response to this procurement nor is the GLA liable for any bid costs, any loss of profit incurred by an organisation in proceeding with or participating in this procurement, including if the procurement process is terminated or amended by the GLA. The GLA does not bind itself to enter into any contract arising out of this procurement. No contractual rights express or implied arise out of this notice or the procedures envisaged by it. Any resulting contracts will be considered contracts made in England and Wales according to English and Wales law.
