Justification for selected award procedure:
The procurement falls outside the scope of application of the Directive
Explanation
The services under this contract are of strategic importance to the Council with the services covering regular planned and reactive tree maintenance which can represent a health and safety risk to the public and as well as public liability risks. There is also a current SLA with the Department for Infrastructure to maintain street trees, which the Council has committed to.
Following a breakdown in negotiations with the incumbent contractor due to poor performance issues, the incumbent contractor (Clark Cunningham Ltd) informed the Council that they were not willing to extend the contract for a further 12 months. This came without notice and there were no previous indications that the contractor was not willing to extend. This left the Council with a 2 to 3 week period to arrange a suitably qualified contractor to replace the incumbent contractor and ensure continuity of service.
Reg 32 (2c) of the Public Contracts Regulations applies in this instance as:
‘insofar as is strictly necessary where, for reasons of extreme urgency brought about by events unforeseeable by the contracting authority, the time limits for the open or restricted procedures or competitive procedures with negotiation cannot be complied with’.
