Section IV: Procedure
IV.1) Description
IV.1.1) Type of procedure
Award of a contract without prior publication of a call for competition
Justification for selected award procedure:
The works, supplies or services can be provided only by a particular economic operator for the following reason: absence of competition for technical reasons
Explanation
It is considered that this contract can be placed using the negotiated procedure without prior publication, this is pursuant to Regulation 32(2)(b)(ii) Public Contracts Regulations 2015 of the European Parliament and of the Council, because competition is absent for technical reasons.
Intepro UK hold the copyright for the software required to operate the PSUATE, they have supported and maintained the equipment for approximately 25 years and have the specialist skills, experience, knowledge and test equipment to continue with the support. The MOD does not have any rights in the software or documentation to be able to pass these to another contractor. The MOD do not hold the source code and any attempts to independently produce equivalent software would introduce significant risk of error, as this equipment is used to test various aircraft power supply units, this approach would introduce unacceptable risk to aircraft safety and airworthiness. It would also add in a considerable lead time which would mean the Authority’s requirement could not be met in the timescales required with the consequence that the MOD could lose the capability to repair and test various units ultimately leading to grounded aircraft. Therefore, Intepro UK are considered to be the only economic operator technically capable of providing this requirement.
