Section IV: Procedure
IV.1) Description
IV.1.1) Type of procedure
Award of a contract without prior publication of a call for competition
Justification for selected award procedure:
Additional deliveries by the original supplier ordered under the strict conditions stated in the Directive
Explanation
Negotiated procedure without prior publication procurement in reliance on reg.32 (5) (b) of the PCR 2015
1) DHSC awarded the contract for the supply of test kits on 1 April 2020.
2) DHSC requires additional deliveries from Abbott Laboratories Ltd (the original supplier) of the test kits as an extension of existing supplies in order to continue to provide an effective response to the Covid-19 pandemic and improve the Government’s testing programme.
3) DHSC understands, from enquiries made from its own technical experts, that the test instruments on which the test kits will operate are a ‘closed’ platform, meaning that only goods manufactured by Abbott can work with it and a therefore a change of supplier would oblige the DHSC to acquire supplies having different technical characteristics which would result in incompatibility in the operation of the test kits.
