The contracting authority has identified a need to acquire additional deliveries of road traffic collision hydraulic rescue equipment by its original supplier of such equipment in order to ensure its compatibility therewith. A change of supplier would oblige the contracting authority to acquire equipment with different technical characteristics that would result in incompatibility and disproportionate technical difficulties in operation and maintenance and lead to operational risks which would be detrimental to public safety. Although the value of the proposed contract is below the thresholds prescribed under Regulation 5 of the Public Contracts Regulations 2005, the contracting authority has published this Voluntary Ex Ante Transparency (VEAT) notice in order to promote transparency.

II.2.4) Description of the procurement
Although the value of the proposed contract is below the thresholds prescribed under Regulation 5 of the Public Contracts Regulations 2005, this Voluntary Ex Ante Transparency (VEAT) notice has been published to promote transparency and to indicate that the contracting authority intends to award a contract for the supply of seven (7) sets of road traffic collision (RTC) hydraulic rescue equipment to the contracting authority’s original supplier of such equipment in order to ensure compatibility therewith.

IV.1) Description
IV.1.1) Type of procedure
Award of a contract without prior publication of a call for competition
Justification for selected award procedure:
The procurement falls outside the scope of application of the Directive
Explanation:
The value of the proposed contract award is below the thresholds prescribed under Regulation 5 of the Public Contracts Regulations 2005. Moreover, had the value of the proposed contract exceeded such thresholds, the award would have been permissible in any event under Regulation 32(5)(b) of PCR 2015 on the basis that the negotiated procedure without prior publication may be used for public supply contracts for additional deliveries by the original supplier which are intended either as a partial replacement of supplies or installations or as the extension of existing supplies or installations where a change of supplier would oblige the contracting authority to acquire supplies having different technical characteristics which would result in incompatibility or disproportionate technical difficulties in operation and maintenance. The council’s original supplier of road traffic collision hydraulic rescue equipment is the only supplier of the Milwaukee M28 batteries that are used to power such equipment across the contracting authority’s entire fleet of fire appliances, hence a change of supplier would oblige the contracting authority to acquire equipment having different technical characteristics which would result in incompatibility, disproportionate technical difficulties in operation and maintenance and give rise to operational risks which would be detrimental to public safety.
