A contract was awarded under reg. 32(2)(b)(ii) of The Public Contract Regulations 2015 as the District Heat Network provided by Mersey Heat Limited is the only District Heat Network available and it would be impossible for technical reasons for another provider to construct a competing District Heat Network within any reasonable time.
