Abstract

Clwyd Pension Fund (the “Fund”) is seeking to appoint an Independent Person to provide scrutiny, constructive challenge to advice given, and to support the Pension Fund Committee and Head of Fund (LGPS Senior Officer). The role forms part of the strengthened governance framework for LGPS administering authorities as a result of MHCLG's implementation of the LGPS Good Governance reforms.

Flintshire County Council, as Administering Authority for the Clwyd Pension Fund, provides pension benefits on behalf of over 50 participating employers and over 50 thousand scheme members. The Fund is proud to be widely acknowledged in the LGPS community as a leading example for best practice governance and management. The Independent Person will become a key person in the Fund’s commitment to delivering high-quality pension services, robust governance and management arrangements that support members, employers and other stakeholders.

The Independent Person will bring an external perspective and enhance the Fund's governance framework, supporting the Pension Fund Committee, the Pension Board, LGPS Senior Officer and other Fund officers in maintaining the highest standards of governance, transparency and accountability.

The role will be critical in strengthening governance practices, providing objective and expert insight, constructive challenge where appropriate, identifying opportunities for improvement and supporting compliance with LGPS legislation, statutory guidance and regulatory expectations across all areas of Fund activity. The successful candidate will be independent of Clwyd Pension Fund and Flintshire County Council, with no conflicts of interest that could compromise their impartiality. To ensure independence, both actual and perceived, in accordance with the Statutory Guidance, they cannot work for any advisor, fund manager or service provider that does business with the Fund (or has provided any such services within the last two valuation cycles). They will work collaboratively with elected members, pension board representatives and officers while maintaining an independent viewpoint.

Mae Cronfa Bensiynau Clwyd (y “Gronfa”) eisiau penodi Unigolyn Annibynnol i ddarparu craffu, her adeiladol i’r cyngor a roddir, ac i gefnogi’r Pwyllgor Cronfa Bensiynau a Phennaeth y Gronfa (Uwch Swyddog CPLlL). Mae’r rôl yn ffurfio rhan o fframwaith llywodraethu wedi’i atgyfnerthu ar gyfer awdurdodau gweinyddu CPLlL o ganlyniad i weithrediad y Weinyddiaeth Tai, Cymunedau a Llywodraeth Leol o ddiwygiadau Llywodraethu Da CPLlL.

Mae Cyngor Sir y Fflint, fel Awdurdod Gweinyddu ar gyfer Cronfa Bensiynau Clwyd, yn darparu buddion pensiwn ar ran dros 50 o gyflogwyr a thros 50 mil o aelodau’r cynllun. Mae’r Gronfa’n falch o gael ei chydnabod yn eang yn y gymuned CPLlL fel enghraifft arweiniol o reoli a llywodraethu arferion gorau. Bydd yr Unigolyn Annibynnol yn dod yn unigolyn allweddol o ran ymrwymiad y Gronfa i ddarparu gwasanaethau pensiwn o’r radd flaenaf, trefniadau rheoli a llywodraethu cadarn sy’n cefnogi aelodau, cyflogwyr a budd-ddeiliaid eraill.

Bydd yr Unigolyn Annibynnol yn dod a safbwynt allanol ac yn gwella fframwaith llywodraethu’r Gronfa, gan gefnogi’r Pwyllgor Cronfa Bensiynau, y Bwrdd Pensiynau, Uwch Swyddog CPLlL a swyddogion eraill y Gronfa i gynnal safonau uchaf o lywodraethu, tryloywder ac atebolrwydd.

Bydd y rôl yn hanfodol i gryfhau arferion llywodraethu, darparu mewnwelediad arbenigol a gwrthrychol, her adeiladol lle bo’n briodol, canfod cyfleoedd i wella a chefnogi cydymffurfiaeth gyda deddfwriaeth CPLlL, canllawiau statudol a disgwyliadau rheoleiddio ar draws holl feysydd o weithgarwch y Gronfa. Bydd yr ymgeisydd llwyddiannus yn annibynnol o Gronfa Bensiynau Clwyd a Chyngor Sir y Fflint, heb unrhyw wrthdaro buddiannau a all fygwth eu didueddrwydd. Er mwyn sicrhau annibyniaeth, gwirioneddol a chanfyddedig, yn unol â Chanllawiau Statudol, ni allent weithio ar gyfer unrhyw ymgynghorydd, rheolwr cronfa neu ddarparwr gwasanaeth sy’n gwneud busnes gyda’r Gronfa (neu sydd wedi darparu gwasanaethau o’r fath o fewn y ddau gylchred prisio diwethaf). Byddent yn cydweithio gydag aelodau etholedig, cynrychiolwyr y bwrdd pensiynau a swyddogion wrth gynnal safbwynt annibynnol.
