Abstract

LHC Procurement Group Limited (LHCPG) is procuring the Refurbishment and Modernisation Scotland Framework Agreement (RM4S) on behalf of the Scottish Procurement Alliance (SPA). LHCPG is acting as the Contracting Authority and central purchasing body for this procurement.

The Framework is being procured solely for use in Scotland and will provide eligible public sector organisations with a compliant and flexible route for the delivery of refurbishment, improvement, repair, maintenance and modernisation works, goods and associated services across residential and non-residential buildings.

The procurement is being conducted using the Open Procedure in accordance with the Procurement Act 2023 and the Procurement Regulations 2024. When awarding Call-Off Contracts, eligible Clients and Partners must also comply with the Framework Agreement, the applicable Call-Off procedure and any other procurement legislation applicable to them.

RM4S builds upon the existing Refurbishment and Modernisation Framework and has been developed following market engagement with suppliers and public sector organisations. Feedback received through that engagement has informed the scope, Workstreams, Lot structure, value bands and regional arrangements.

The Framework comprises the following Workstreams and Lots:

Kitchens and Bathrooms, from zero to 500k

Kitchens and Bathrooms, 500k to 2m

Reactive Repairs and Maintenance

Multi-Disciplinary Works, from zero to 750k

Multi-Disciplinary Works, 750k to 2.5m

Multi-Disciplinary Works, 2.5m and above

Kitchens (Supply only)

The scope may include planned and reactive maintenance, refurbishment and improvement programmes, component replacement, compliance-led works, accessibility adaptations, environmental and external works, property modernisation and wider asset management and investment programmes.

Each Lot is divided into five regional areas covering North Eastern Scotland, Highlands and Islands, Eastern Scotland, West Central Scotland and Southern Scotland. Bidders may apply for one or more Lots and regional areas in accordance with the Procurement Documents.

Subject to there being sufficient Qualifying Bidders, LHCPG will appoint no more than 10 Appointed Companies for each Lot and regional area. Where a Micro and Small Enterprise Reserved Allocation applies, it forms part of, and is not additional to, the maximum of 10 appointments. The Framework will not operate a reserve list and no additional or replacement Bidders may be appointed during the Framework Term.

The Framework is structured to support participation from organisations of different sizes and capabilities through its Workstreams, value bands, regional areas and applicable Micro and Small Enterprise Reserved Allocations. All Bidders will remain subject to the same published qualification, compliance, quality, evaluation and appointment requirements.

RM4S is intended to support the delivery of high-quality and compliant solutions, sustainable supply chains, environmental improvement, social value, community benefits, Fair Work and proportionate innovation. Detailed technical requirements, eligibility provisions, award criteria, appointment methodology and Call-Off procedures are set out in the Procurement Documents.

Section III: Legal, economic, financial and technical information

III.1) Conditions for participation

III.1.1) Suitability to pursue the professional activity, including requirements relating to enrolment on professional or trade registers

List and brief description of conditions:

The registrations, accreditations and certifications required vary by Lot. Full details of the applicable minimum requirements are set out in the Procurement Documents available through the In-Tend eTendering portal. Bidders must complete the four Selection Questionnaires within In-Tend, which contain selection questions aligned with the SPD (Scotland). The applicable requirements will be assessed on a pass/fail basis.

Procurement Documents and Selection Questionnaires are available at thttps://supplier.in-tend.co.uk/lhc/tenders/details/3765ab7f-bd69-4104-b5e4-c9e8abe2e999

III.1.2) Economic and financial standing

List and brief description of selection criteria:

Bidders must demonstrate sufficient Economic and Financial Standing to perform the Framework and the Lot(s) for which they submit a Tender. EFS will be assessed separately for each Lot as a pass/fail Condition of Participation and will not form part of the scored quality or price evaluation.

Bidders must complete and submit Appendix 6 – RM4S FVRA Workbook and all supporting financial information required by the Procurement Documents. The completed workbook must include the Bidder’s supplier details, declarations, applicable financial metrics, supplier type and confirmation of every Lot for which the Bidder is applying.

Each Lot has been assigned a Bronze, Silver or Gold financial information route. Bronze Lots use a proportionate basic financial information route. Silver Lots require the published Standard or VCSE financial metrics and supporting evidence. Gold Lots require the Silver information set together with any additional analysis, trend information, mitigation evidence, resolution-planning information or financial assurance evidence specified in the Procurement Documents.

Bidders must select the Standard or VCSE route, as applicable. LHCPG may verify the selected supplier type and request supporting evidence.

Appendix 6 compares submitted information against the published minimum requirements and indicative EFS benchmarks. An indicative benchmark warning is not an automatic failure. It identifies an area that may require explanation, mitigation evidence or further assurance. The workbook outputs are indicative prompts only and do not constitute LHCPG’s final evaluation or pass/fail decision.

LHCPG will determine the final EFS outcome using the completed workbook, supporting evidence, relevant credit-reference information, any permitted clarification or alternative evidence and any properly evidenced reliance on another entity.

Bidders applying for more than one Lot will be assessed separately for each Lot. A Bidder may satisfy the EFS requirements for one Lot but not another. The Lot-specific turnover requirements will not be added together solely because a Bidder applies for multiple Lots.

Full details of the methodology, financial information routes, minimum requirements, indicative benchmarks, evidence requirements and clarification arrangements are set out in the Procurement Documents.

Minimum level(s) of standards required:

Bidders must satisfy the minimum annual turnover requirement applicable to each Lot for which they submit a Tender:

Lot 1: 250,000; Lot 2: 100,000; Lot 3: 750,000; Lot 4: 250,000; Lot 5: 1,000,000; Lot 6: 2,500,000; Lot 7: 250,000; Lot 8: 500,000; Lot 9: 250,000; Lot 10: 100,000; Lot 11: 250,000; Lot 12: 1,000,000; Lot 13: 500,000; Lot 14: 1,500,000; Lot 15: 5,000,000; and Lot 16: 300,000.

Where required by the applicable Bronze, Silver or Gold financial information route, Bidders must also satisfy the published minimum financial requirements.

The minimum turnover-to-estimated-annual-Lot-value ratio is 1.0.

For the Standard route, the minimum requirements are: operating margin of at least 2.0%; net debt to EBITDA of no more than 2.0; net debt plus net pension deficit to EBITDA of no more than 3.5; interest paid cover of at least 3.0; acid ratio of at least 0.8; net assets greater than zero; and group exposure ratio of no more than 50%.

For the VCSE route, the minimum requirements are: operating reserve ratio of at least 2.0; operating reliance ratio of at least 0.5; donations and legacy reliance ratio of no more than 50%; and operating cash ratio of at least 0.5.

A metric applies only where it is required for the relevant Lot and supplier route. An indicative EFS benchmark warning is not an automatic failure but may require explanation, mitigation evidence or further assurance. Full details are set out in Appendix 6 – RM4S FVRA Workbook and the Procurement Documents.

III.1.3) Technical and professional ability

List and brief description of selection criteria:

Bidders must demonstrate that they have the technical and professional ability, relevant experience, capacity, resources, systems and competence required to deliver the works, goods and/or services covered by the Lot(s) and regional area(s) for which they are tendering.

The applicable technical and professional ability requirements vary by Lot and will be assessed on a pass/fail basis through the four Selection Questionnaires within the In-Tend eTendering portal, which contain selection questions aligned with the SPD (Scotland), and through the supporting evidence required by the Procurement Documents.

Bidders must provide all information, declarations and supporting evidence requested in the Procurement Documents. This may include evidence relating to relevant experience, technical capability, health and safety, environmental management, quality management, equality legislation, required accreditations and certifications, and any other Lot-specific mandatory requirements.

Where a Bidder submits a Tender as a consortium or relies on another entity’s technical or professional ability, resources, systems or certifications, the relevant information and evidence must be provided in accordance with the Procurement Documents.

A Bidder that fails to satisfy an applicable technical and professional ability requirement, mandatory pass/fail requirement or evidence requirement may be excluded from further assessment in respect of the affected Lot(s) and/or regional area(s).

Full details of the applicable requirements and evidence to be submitted are set out in the Procurement Documents and Selection Questionnaires available through the In-Tend eTendering portal: https://supplier.in-tend.co.uk/lhc/tenders/details/3765ab7f-bd69-4104-b5e4-c9e8abe2e999

Minimum level(s) of standards required:

Full details of the minimum requirements that Bidders must satisfy to be considered eligible for appointment to each Lot and regional area are set out in the Procurement Documents.

III.2) Conditions related to the contract

III.2.2) Contract performance conditions

Appointed Companies must maintain appropriate procedures and systems to support performance monitoring and reporting under the Framework and Call-Off Contracts.

They must provide performance data in accordance with the Framework Agreement, Procurement Documents and applicable Call-Off Contract. This may include cost, time, quality, health and safety, customer satisfaction, defects, environmental performance, social value and community benefits.

Relevant and proportionate project-specific KPIs, reporting requirements and performance standards may be specified at call-off stage.

Where performance falls below the required standard, corrective or remedial action may be required in accordance with the applicable contractual terms. Further details are set out in the Procurement Documents, Framework Agreement and Call-Off Contract.
